Below is an overview of the preliminary steps for filing a mechanic’s lien in the state of Oklahoma.
COMMERCIAL:
- Upfront Notice: BICA sends a Courtesy Notice.
- Follow-up Notice:
- Pre-Lien Notice:
- Required within 75 days of last delivery.
- Only required if dollar amount is greater than $10,000.
- BICA will include with this notice a request to the General Contractor for the owner’s name and last known address. If the GC fails to respond to this request within five days of receiving it, the Pre-Lien requirement becomes unenforceable.
- This notice is available on the BICA member portal.
RESIDENTIAL:
- Upfront Notice: BICA sends a Courtesy Notice.
- Follow-up Notice:
- Pre-Lien Notice:
- Must be sent within 75 days of last delivery.
- This is required on all owner-occupied projects regardless of dollar amount.
- It is not required for single family or multifamily projects of four or fewer dwelling units none of which are occupied by an owner.
- This notice is available on the BICA member portal.
PUBLIC:
- Upfront Notice: BICA sends a Courtesy Notice.
- Follow-up Notice (if not paid):
- Oklahoma Public Claim on Bond:
- Required to be sent to the Contractor and Surety within 90 days of last delivery.
- This notice is available on the BICA member portal.
