Below is an overview of the preliminary steps for filing a mechanic’s lien in the state of Idaho.
COMMERCIAL:
- Upfront Notice: BICA sends a Courtesy Notice.
- Follow-up Notices: There is no statutory follow-up notice.
RESIDENTIAL:
- Same handlings as for Commercial jobs.
- Note: The General Contractor is required to supply a “Residential Disclosure” statement to the homeowner before entering into any contract exceeding $2,000.
PUBLIC:
- Upfront Notice: BICA sends a Courtesy Notice.
- Follow-up Notices:
- Notice to Contractor (“Public Contracts Bond Act”—modeled after the federal Miller Act):
- If not working directly for the GC, this notice is required to be sent to the Contractor within 90 days of last delivery or work on the job.
- This notice is available on the BICA member portal.
